Motorcycle
Drivers
 |
All
motorcycle drivers must be a minimum of 18 years of age
and possess a legal and valid motorcycle operators
license from the country of their legal residence.
Driver must be in possession of their motorcycle
operators license at all times. |

Driver must
wear an
approved helmet style, eye protection, shirt and
full shoes at all times when operating a motorcycle
owned by Island Motor Tours, Inc. Any style of sandal
or open-toed shoe is not considered a full shoe. Any
style of shirt is acceptable other than a bathing suit
or bikini top. |
 |
Driver agrees
to notify Island Motor Tours, Inc. security staff prior
to operating any motorcycle independent of the complete
presence of the tour group and all Island Motor Tours,
Inc. tour support staff. Driver shall be required to
provide our security staff with the information of
destination and expected time of arrival when the
motorcycle shall be returned. |
 |
Driver shall
not operate any motorcycle owned by Island Motor Tours,
Inc. while under the influence of alcohol or any illegal
drug. Driver shall not operate any motorcycle owned by
Island Motor Tours, Inc. while under the influence of
any prescription drug that would have the potential to
impair the drivers ability to safely operate the
motorcycle. |

Driver shall
not take passengers on-board his/her motorcycle other
than the immediate members of the tour group or Island
Motor Tours, Inc. tour support staff. All passengers
must be in full compliance with all terms and conditions
as set forth under the heading
Motorcycle Passengers. |
 |
At no time
shall driver accept more than one passenger on-board
his/her motorcycle. Passenger must be a member of the
tour group or a tour staff member of Island Motor Tours,
Inc. |
 |
Driver may
not operate any motorcycle owned by Island Motor Tours,
Inc. while wearing swimming attire. |
 |
Drivers may
not, at any time, smoke, eat or drink while operating
any motorcycle owned by Island Motor Tours, Inc. |
 |
Drivers shall
at all times operate their assigned motorcycle within
all laws governing the use of public roads and highways
and all laws regarding the operation of a motorcycle
within the Republic of the Philippines (indoctrination
will be provided)

Motorcycle
Passengers
 |
Passenger
must be 12 years of age or older. |
 |
Passenger
must be a member of the tour group or a member of the
Island Motor Tours, Inc. tour staff. |
 |
Passenger
must, at all times, wear an
approved

at all times when operating a motorcycle owned by Island

If passenger
is deemed by any member of Island Motor Tours, Inc. tour
staff to be intoxicated or to be in a condition that
would cause a concern for the passenger's safety,
passenger shall be required to ride in the tour van
until such time that the passenger is deemed suitable
and safe to ride as a motorcycle passenger. |
 |
Passengers
may not smoke, eat or drink while on-board a moving
motorcycle owned by Island Motor Tours, Inc.
|
|
 |
Possession
of Motorcycle Keys
 |
Motorcycle
driver shall maintain possession, on their person, of
the keys for his/her assigned motorcycle at all times
when motorcycle is not in use or expected to not be in
use for periods of 15 minutes or less. |
 |
Motorcycle
keys shall be turned over to Island Motor Tours, Inc.
security staff at all times when his/her assigned
motorcycle is not in use, or expected to not be in use
for a period of time in excess of 15 minutes. |
 |
At no time
shall any member of a tour group make any copies of keys
used to operate any motorcycle owned by Island Motor
Tours, Inc. |
 |
A fee of PHP
50,000 per key set shall be assessed to any individual
found in possession of an unauthorized copy or set of
keys that will operate any motorcycle owned by Island
Motor Tours, Inc.. In addition to such fees, any person
found in possession of an unauthorized copy or set of
keys that will operate any motorcycle owned by Island
Motor Tours, Inc. may be subject to expulsion from the
tour group, at the sole discretion of the tour guide.

If driver
should misplace or lose a set of keys that operates any
motorcycle owned by Island Motor Tours, Inc., driver
shall immediately notify any member of Island Motor
Tours, Inc. security staff. There shall be no fee or
penalty assessed to the driver for a replacement set of
keys if the original set of keys issued to the driver
are lost, misplaced or stolen.

Use
of Motorcycles
 |
Motorcycles
owned by Island Motor Tours, Inc. shall only be operated
on public roads and highways an shall not be taken
off-road or ridden over rough or hazardous terrain at
any time. |
 |
Motorcycles
may be operated independently of tour group and while
not in the presence of Island Motor Tours, Inc. support
staff provided that the tour group is not traveling from
one destination point to another and also provided that
the motorcycle driver has notified any member of Island
Motor Tours, Inc. security staff as to his/her
destination and expected time of arrival to return the
motorcycle. |
 |
At no time
shall a driver operate any motorcycle owned by Island
Motor Tours, Inc., other than the motorcycle that has
been assigned for his/her personal usage, unless by
written permission of any member of Island Motor Tours,
Inc. tour staff. |
 |
At no time
shall a driver allow his/her assigned motorcycle to be
operated by any other tour group guest with exception of
his/her assigned riding partner and only in the event
that the assigned riding partner is in complete
fulfillment with all terms and conditions as set forth
under the heading
Motorcycle Drivers.

 |
Damage
to Motorcycles
 |
Motorcycles
shall be inspected for damage by each driver and also by
Island Motor Tours, Inc. security staff, prior to usage,
and each time the keys are passed from our security
staff to driver. |
 |
Motorcycles
shall be inspected for damage by each driver and also by
Island Motor Tours, Inc. security staff, immediately
after usage, and each time the keys are passed from
driver to our security staff. |
 |
Damage
incurred to motorcycles while the keys are in the
possession of driver shall be deemed the liability of
the driver to remedy. |
 |
Damage
incurred to motorcycles while the keys are in the
possession of Island Motor Tours, Inc. security staff
shall be deemed the liability of Island Motor Tours,
Inc. to remedy. |
 |
Flat tires
and wheel damage caused by unavoidable road hazards
shall be deemed the liability of Island Motor Tours,
Inc. to remedy, regardless of when the damage is
incurred. |
 |
Superficial
damage to motorcycles caused by flying road debris shall
be deemed the liability of Island Motor Tours, Inc. to
remedy, regardless of when the damage is incurred. |
 |
Upon the
identification of any damage to a motorcycle, it shall
be the responsibility of the tour guide to photo
document all damages and make a report of such damages
while in the presence of the identifying Island Motor
Tours, Inc. security staff member and the motorcycle's
assigned driver. |
 |
Any damage
that should result in the motorcycle being considered
unsafe to operate by either the driver or by the tour
guide shall be immediately repaired prior to its
next usage. |
 |
In the event that damage
to a motorcycle should impair
the ability of the driver to ride with the tour group on
any group activity or when traveling from one
destination point to another, and the damage is due to a
non-accident mechanical failure, a replacement motorcycle
will be temporarily assigned to the driver, usually the
motorcycle assigned to the tour guide, until such time
that the damage to drivers originally assigned
motorcycle has been repaired and motorcycle is deemed to
be safe to operate by both the tour guide and the
driver. |
 |
In the event that damage
to a motorcycle should impair
the ability of the driver to ride with the tour group on
any group activity or when traveling from one
destination point to another, and the damage is due to a
mechanical failure or safety issue resulting from an
accident, a replacement motorcycle
will not be to the driver. The driver and his/her
passenger shall ride in the tour van, until such time
that the damage to drivers originally assigned
motorcycle has been repaired and motorcycle is deemed to
be safe to operate by both the tour guide and the
driver. |
 |
Any damage to
a motorcycle that does not affect the ability of the
motorcycle to be operated in a safe condition shall be
repaired at the earliest available opportunity, at
the discretion of the tour guide, and shall not
constitute a need for the driver to be issued a
replacement motorcycle. |
 |
Should any
driver be involved in a motorcycle accident that
involves another motorcycle, motor vehicle, person or
private property, and while the driver is operating
his/her motorcycle independently of the tour group, and
regardless of whether or not any injury to persons or
damage to private property is identified;
 |
The
driver shall immediately notify the tour guide
by means of his assigned cell phone and shall
not leave the scene of the accident for any
reason other than for personal safety and shall
not move the motorcycle from the scene of the
accident unless done so by Philippine Law
Enforcement authorities.

 |
Driver shall immediately remove the keys from
the motorcycle and maintain possession of the
keys until such time that Island Motor Tours,
Inc. security staff arrives on scene or until
such time that the motorcycle keys are requested
by Philippine Law Enforcement authorities.
|
 |
Driver shall not admit fault or indicate the
fault of others or discuss the nature of the
accident with any persons other than to answer
the direct questions of Philippine Law
Enforcement authorities and until such time that
Island Motor Tours, Inc. security staff and tour
guide are present on the scene and can assess
the need for legal council to be involved and/or
present during questioning.
 |
The
assessment of whether or not there is a
foreseen need for legal council to be
involved shall be made solely at the
discretion of and by the determination
of the driver and not by any member of
Island Motor Tours, Inc. tour staff. We
simply wish to survey the situation, act
as your liaison with the Philippine Law
Enforcement authorities and/or damaged
parties in protecting your rights and
give you our personal opinions so you
can make an educated and informed
decision.

Motorcycle
Liability & Collision Insurance
 |
Island Motor
Tours, Inc. carries a motorcycle insurance policy on all
motorcycles that insures against damage to the
motorcycle, 3rd party personal property damage, driver
and passenger medical payments and 3rd party medical
payments. All provisions cover the driver and passenger.
We carry the maximum coverage available in all
categories.
 |
Collision
Liability - Our policy protects the motorcycle up to the
full replacement cost with a 5,000 peso deductible. |
 |
Our policy
provides 50,000 pesos in coverage for medical payments
of the driver and 25,000 pesos in coverage for the
passenger |
 |
Our policy
covers 3rd party property damage to the amount of 50,000
pesos |
 |
The policy
has a maximum per accident liability of 100,000 pesos |

 |
Your liability as
the driver is in respect to any and all deductibles, any
unpaid amounts or liabilities not expressly covered by the
insurance policy and any civil liabilities imposed by 3rd
party plaintiffs. |

Tour Inclusive
Items & Expenses
 |
The following
items and expenses are included at no cost as part of
the "all-inclusive" tour package fee;
 |
Transfers from Bancasi airport to the Almont
Inland Resort in Butuan on the date of arrival
and transfers from Almont Inland Resort to
Bancasi Airport on the date of departure for 2
persons. |
 |
Lodging for 2 persons, one room, one double or 2
single beds (to be determined by guest and
resort facilities), at all resorts for all
nights while on tour including first and last
night. All rooms are air conditioned with hot
and cold showers. All rooms are private except
where noted in the tour itinerary. |
 |
All
bed linens and towels as provided by the
resort/hotel as the standard room amenities.
Additional towels will generally be provided by
the resort/hotel at no charge and upon request. |
 |
Breakfast, Lunch and Dinner meals for 2 persons
at the prescribed restaurant (usually the resort
restaurant). There shall be no limit placed on
the value of the food being consumed but all
food ordered must be consumed at the time of the
meal and no food shall be taken back to the
resort room or stored in the motorcycle unless
with the previously arranged and expressed
consent of the tour guide. |

All
breakfast, lunch and dinner, non-alcoholic,
beverages including sodas, water, tea, coffee
and shakes. |
 |
All
snacks and non-alcoholic beverages consumed
while traveling from one destination point to
another and during tour group functions and
group activities considered to be part of the
tour itinerary. |
 |
A
collective allowance of 250pesos/tour night, per
driver/passenger couple, for consumption of
mini-bar snacks and drinks where provided as an
amenity of the resort/hotel room. |

Motorcycle rental for one driver and one
passenger, starting on the date of arrival and
ending on the day preceding the date of
departure. |

A

cash for your own personal use in

apart from the tour group. |

The
set cost of the tour is the "4 motorcycle" cost
as displayed under the heading Tour Cost
on the pages detailing the specific tour routes.
Tour will not be run if we fail to book 4
motorcycles by the scheduled tour registration
cut-off date posted under the Lone Riders Run
heading on the pages detailing the specific tour
routes |

Advance booking
deposit of 25% is required to secure your spot on the tour.
This deposit is non-refundable unless we fail to book 4 or
more motorcycles on tour at the 3 month mark prior to the
start of the tour, in which case your deposit would be fully
refunded minus our wire transfer and currency exchange fees. |
 |
Should we be
successful in booking a minimum of 4 motorcycles at the 3
month mark, your deposit becomes non-refundable and you will
be required to make an additional 25% deposit at the 2 month
mark prior to the tour start date. We will continue to
accept bookings for the tour until we reach 6 motorcycles at
which time the tour will become closed to additional
bookings. |
 |
If the booking
period on one of the lone riders runs is between the 3 month
and 2 month marks and you happen to be lucky enough to find
a spot available, you can still secure a spot on tour with a
50% booking deposit that is non-refundable. No additional
bookings will be accepted at the 2 month mark prior to the
tour start date. |
 |
The remaining 50%
balance is due at the one month mark, same as our policy
with all other tours. If we are successful in booking 5 or 6
motorcycles, then we will adjust the tour cost
for all bookings to the appropriate rate, based
on the total number of motorcycles booked, and
the final deposit amount will be adjusted to
reflect the decrease in cost. All other payment policies are the
same. |

Payment Policy
 |
All tours are priced
in Philippine Pesos (PHP) and this is a fixed price. Currency
exchange rates
fluctuate on a minute by minute basis, 24 hours a day, same as stock prices, so
the amount you pay in your currency will vary slightly but
usually never more than 1-2% over a period of 30 days.

A booking fee of 50%
is due 60 days prior to the scheduled start date of your tour.
The remaining balance is due 30 days prior to your
scheduled start date.
 |
Booking fee is
non-refundable if you decide to re-schedule or cancel your
tour. We use this portion of the payment to make all resort
reservations, airline reservations for your round trip
flight from Manila to Butuan and sometimes ferry
reservations at certain ports where the more luxurious
accommodations on the ferries are known to stay booked solid
as much as 1 month or more in advance. Some resorts require we make
reservations as much as 45 days in advance to secure their
luxury rooms. These reservation fees are non-refundable to
us if your tour is rescheduled or cancelled. |
 |
Please make sure you will be
able to travel on the dates you plan. Never book a tour
unless all tour guests have their passports in hand and
round trip airplane reservations to Manila confirmed. These
are the 2 primary reasons why tours need rescheduling. |
 |
The second payment
made to us (50% balance) is also non-refundable,
once it is deposited into our bank account.
Again, please be as confident as possible about
your ability to travel on the dates you plan. We
use the first half payment to make all
reservations and we use a considerable part of
the second half payment to pay the remaining
balances of these reservations. |
 |
Considering that we
only operate one tour at a time and that we must
plan ahead by as much as 45-60 days, if you cancel
your tour then we have no ability to fill the
slot with another tour group. Additionally,
considering that over 80% of the money we
receive from you is spent before you arrive, we
simply cannot issue any refunds for issues
beyond our control. |

All payments are made by
international wire transfer into our account in the Philippines. You are
responsible for paying all wire transfer fees and currency
exchange fees. The amount we receive in our account must equal
the fixed PHP tour cost. Please make sure to shop rates from
various financial institutions prior to making your transfers.
Although international wire transfer fees are generally about
the same from one bank to another, currency
exchange fees can range from 1% to 5%. Sometimes, a currency
broker can be your best option. Make sure you are getting a good
rate !!!

Please make sure your financial
institution understands that your wire transfer needs to equal a
specific amount of foreign currency after all fees. Any
discrepancy in the total amount of actual funds received into
our account and the actual tour cost will be payable in cash
upon arrival or refunded if over paid. |
 |
We require that your
wire transfers be made as single transactions
for the deposit and final payment for the
combined total cost of all motorcycles on tour,
instead of individual transfers from each of the
tour members. Not only does this make our life
much simpler in tracking and registering your
payments, it will also save your tour group a
considerable amount of money in wire transfer
fees and also give you more favorable terms if
you choose to use a currency broker. Please
explore these suggestions with due diligence.

Entry
(VISA) Requirements
(No VISA Required !!!)
 |
You do not need any special VISA to
enter the Philippines as a visitor or tourist. By executive order of
the President of the Philippines, you are allowed entry for a period
up to 21 days upon the presentation of your valid passport and
round-trip airplane ticket showing the difference in arrival and
departure dates as less than or equal to 21 days. |

Drivers License Requirements
(No International Drivers License Required !!!)
 |
Your current and valid motorcycle
operators permit from your home country is valid here for a
period of 90 days so there is no need for you to go thru the
expense and hassle of obtaining an international drivers
license. If you are thinking about applying for and obtaining a
Philippines drivers license to take home as a souvenir, sorry, you must be in the
Philippines for a minimum of 90 days before you can apply.

Illegal Drugs
 |
At no time shall any member
of a tour group be in possession of illegal drugs while
on tour. |
 |
At no time shall any member
of a tour group attempt to acquire or purchase illegal
drugs while on tour. |
 |
At no time shall any tour
member engage in the use of an illegal drug while on
tour. |
 |
If you are thinking about bringing any
illegal drugs with you or possibly acquiring them while
you are on tour then you probably should not come here.
The Philippines is notorious for being very strict on
prosecuting and incarcerating anyone, and I mean anyone,
who they have any indication is in the possession of,
using or trying to obtain illegal drugs.

At the airport in Manila when
you pass thru customs and at every ferry crossing you
can expect to have your bags hand searched, x-rayed and
sniffed by the dogs. |
 |
Any tour member who is found
to be using, in possession of or attempting to purchase
illegal drugs will be immediately expelled from the tour
group as a matter of corporate policy. (see also
Expulsion From
the Tour Group) |
 |
It shall be the liability of
the offending party to make their own legal arrangements
and pay their own legal fees should any member of the
tour group be arrested by Philippine Law Enforcement
authorities due to any illegal drug violation
 |
Should such violation
also involve the seizure of any property of
Island Motor Tours, Inc. including motorcycles
and van, the violating party shall be held
liable for the full cost of replacement of any
seized property. |

 |
Illegal drug means marijuana,
methamphetamine, cocaine, crack cocaine, heroin,
morphine, LSD, ecstasy, peyote, psilocybin, or any other
prescription or non-prescription drug deemed to be
illegal by the laws of the Republic of the Philippines.
|
|
 |
Expulsion
From The Tour Group
 |
Island Motor Tours, Inc.
reserves the right to terminate the tour privileges of,
and remove from within the presence the tour group, any
driver or passenger who displays repeated actions and/or
consistent behavior that places himself/herself in
danger or poses an imminent threat to the safety of the
other tour guests and/or other motorists and/or the
citizens and residents of the Republic of the
Philippines and as defined by specific provisions of the
terms and agreement as set forth herein. |
 |
The decision to expel any
driver or passenger from the tour group shall rest
exclusively with the tour guide, shall be made with all
due consideration and respect to the safety, wellbeing
and protection of private properties of the tour guests,
Island Motor Tours, Inc., its officers, agents,
contractors, vendors, employees and the residents and
citizens of the Republic of the Philippines and the
decision of the tour guide shall be final and binding. |
 |
If expelled from the tour
group, Island Motor Tours Inc. shall make all necessary
preparations to return the driver/passenger to the point
of arrival in Butuan City and make suitable lodging and
meal arrangements in Butuan City so as to ensure the
ability of the driver/passenger to be able to board
their return flight from Butuan to Manila on the
departure date as originally set forth in the tour
itinerary and description. |
 |
Payment of fees incurred from
additional lodging, travel and meal arrangements and
expenses that are not specifically listed as being part
of the tour itinerary and are accrued by any
driver/passenger expelled from the tour group shall be
considered the liability of the offending
driver/passenger and shall be deemed payable upon demand
by Island Motor Tours, Inc. and/or its vendors and/or is
contractors, whichever shall apply.

 |
Right
of Detention / Use of Deadly Force
 |
It shall be the right of
Island Motor Tours, Inc.'s security staff to act in a
manner to detain any driver/passenger who is found to be
in willful and or premeditated violation of any Law of
the Republic of the Philippines and that should also
pose a reasonable and/or imminent threat to the civil
liability, protection of private property or physical
injury of another tour guest, Island Motor Tours, Inc.,
its officers, agents, contractors, vendors, employees
and/or the residents and citizens of the Republic of the
Philippines, until such time that the custody of the
offending driver/passenger is turned over to the
appropriate Philippine Law Enforcement authorities or
until such time that the offending driver/passenger is
deemed to no longer be a threat by a consensus opinion
of the tour guide and security staff of Island Motor
Tours, Inc. |
 |
The security staff of Island
Motor Tours, Inc., in accordance with all laws of the
Republic of the Philippines, is authorized and
responsible to use deadly force in the course of
protecting the life and/or physical wellbeing of any
human being and in the course of detention of any person
who poses an imminent threat to the life and/or physical
wellbeing of any human being. |

It shall be the decision of
the tour guide and/or any member of Island Motor Tours,
Inc.'s security staff to authorize and effect the
detention of a driver/passenger. |
 |
It shall be the sole decision
of any member of Island Motor Tours, Inc.'s security
staff to authorize and effect the use of deadly force. |
 |
The use of deadly force by
the security staff of Island Motor Tours, Inc. is
authorized to protect any tour guest or any Island Motor
Tours, Inc. employee, contractor or tour staff member
from any threat of terrorism, extortion or kidnapping
|
|
 |
Minors
(Children under 18 years of age)
 |
All minors shall be in
possession of a certified copy of their birth
certificate as proof of age and as proof of parents. |
 |
All minors must ride as a
passenger on the motorcycle operated by their parent or
legal guardian or ride in the tour van |
 |
Any adult claiming to be the
legal guardian of a minor, where the adult is not listed
as being the birth parent on the birth certificate of
the minor, shall provide certified legal documentation
as proof of status of legal guardian. |
 |
At no time shall any minor
engage in the use of alcohol while on tour or be taken
to any domestic establishment deemed inappropriate for
minors, including but not limited to bars, men's clubs
and casinos. |
 |
It is the sole responsibility
of the parent or legal guardian to determine whether or
not any activity or item defined by and/or described in
the tour itinerary is appropriate and/or safe for the
minor in their custody.

of Responsibility
of Island Motor Tours, Inc.

Island Motor Tours, Inc., as
an accredited tour operator by the Philippine Dept. of
Tourism, is responsible within the definition of the
duty and care of a merchant in good standing, for
arranging and providing the tour amenities, rentals and
services as listed in the motorcycle tour itinerary and
as described in writing within our website and printed
advertisements. |

Island Motor Tours, Inc.
continuously monitors our vending hotels/resorts,
contractors and employees to ensure their compliance
with our contracted arrangements and to ensure that the
highest level of quality, value and graciousness is
extended to our tour guests. |
 |
Island Motor Tours, Inc. is
responsible to provide conscientious travel preparations
for our tour guests. |
 |
The tour guides employed by
Island Motor Tours, Inc., as accredited tour guides by
the Philippine Dept. of Tourism, are responsible to
provide factual and historically accurate information to
our tour guests, promote an understanding and respect
for Filipino culture and heritage and promote the
preservation of eco-tourism resources of the Republic of
the Philippines. |

Island Motor Tours, Inc. is
responsible to dictate and enforce a safety policy that
precipitates the safety and enjoyment of our tour
guests. |
 |
Island Motor Tours, Inc. is
responsible to provide life-saving first aid, to the
best of our abilities, in the event of a medical
emergency. |
 |
Island Motor Tours, Inc. is
responsible to provide an armed security force to
protect the personal properties and physical well being
of Island Motor Tours, Inc, our tour guests and tour
staff and to act as a deterrent to all threats to life
and personal property of Island Motor Tours, Inc, our
tour staff and our tour guests.

Acknowledgment
of
Responsibility of Driver and Passenger
 |
Both driver and passenger
accept responsibility for, and agree to stand in
compliance with, all terms and conditions as set forth
herein. |
 |
Both driver and passenger
accept the responsibility of ensuring their own safety
and acknowledge that they ride at their own risk of
personal injury, property damage and/or loss of life. |
 |
Both driver and passenger
accept the responsibility to operate their assigned
motorcycle within the laws associated with the use of
public roads and highways and in respect to the
operation of a motorcycle within the Republic of the
Philippines. |
 |
Both driver and passenger
agree to follow all specific and general requests of the
tour guide and security staff with respect to the safe
and responsible operation of their assigned motorcycle,
whether riding in the presence of the tour group or when
riding apart from the tour group. |
 |
Both driver and passenger
accept the responsibility to maintain their personal
behavior in consideration of the safety and enjoyment of
the other tour guests and in full respect of the
personal property, character and livelihoods of the
citizens and residents of the Republic of the
Philippines. |
 |
Both driver and passenger
accept the responsibility to take all necessary and
appropriate actions to guard against the damage and/or
theft of their own personal properties and the
properties belonging to Island Motor Tours, Inc. that
have been placed within their care and assigned for
their personal use. |
 |
Driver accepts the
responsibility for his/her choice of riding style and
speed selection even when following a motorcycle tour
guide or when riding within a convoy formation of the
tour group or other motorcyclists. |
 |
Both driver and passenger are
responsible to ride at their own risk and are legally
liable for injury and/or damage caused against other
tour guests, motorists and pedestrians, whether being
led by the motorcycle tour guide or otherwise.

 |
Each driver is responsible to
ride within his/her own skill level and with due
consideration for their own safety, the safety of their
passenger, and the safety of the other tour guests,
motorists and pedestrians.
|
|
 |
Changes
to the Tour Itinerary
 |
Island Motor Tours, Inc.
reserves the right to alter, modify or change any part
of the tour itinerary, without prior written or verbal
notice to customer, and as needed to improve the content
of the itinerary, kept the tour itinerary on schedule
and/or improvise and adapt the itinerary to the changing
and/or unexpected conditions and situations that may
arise during the course of operation of the tour.

Changes to the tour itinerary
shall not constitute a breach of contract and customer
agrees that changes to the tour itinerary, due to
circumstances beyond our control, are necessary and
warranted |
 |
Changes to the tour itinerary
that result in an increased or decreased expense
liability of Island Motor Tours, Inc. may or may not affect
the overall cost of tour participation to the customer.
 |
Any increase in the cost of operating a tour or
fulfilling the tour itinerary, due to changes made to
the tour itinerary by the direction of Island Motor
Tours, Inc. shall not be chargeable to the customer.

 |
Any
decrease in the cost of operating a tour or fulfilling
the tour itinerary and due to changes made to the tour
itinerary by the direction of Island Motor Tours, Inc.
or by the direction of customer shall not be refundable
to the customer. |
 |
Any increase in the cost of
operating a tour or fulfilling the tour itinerary, due
to changes made to the tour itinerary by the direct,
written,
request of a customer, or due to liabilities incurred by
Island Motor Tours Inc., due to the direct actions of a
customer or due to a customer's neglect, shall be
chargeable to the customer and shall be considered due
and payable in full upon demand by Island Motor Tours,
Inc.. |

Any request by a customer to
change the tour itinerary shall be made in writing, by
customer and submitted to the tour guide prior to the
change being considered and/or incorporated into the
tour itinerary.
|
|
 |
Special
Arrangements
 |
Any driver or passenger who
leaves the presence of the tour group or who fails to
complete a motorcycle tour, for any reason, is
responsible to make their own arrangements for
transportation, meals and lodging and is also
responsible for the payment of expenses and fees
incurred therein. |
 |
Any such departure from the
tour group by a driver/passenger shall be considered as
an acknowledgement of the fulfillment of the tour
itinerary and the terms and agreement as stated and set
forth herein. |
 |
No refunds will be issued in
part or in whole as a result of any driver's/passenger's
departure from the tour group.
|

 |
Photo
and Video Archives & Documentation
 |
Island Motor Tours, Inc.
reserves the right to make photo and/or video
documentation and keep archives of any and all tour
events and activities and also reserves the right to use
any and all photo and video documentation on our
website, on printed advertisements and brochures and for
the purpose of promoting and advertising our tour
packages and business. |
 |
Driver and passenger agree to
release all photo and video documentation made by Island
Motor Tours, Inc. for the purposes as stated herein and
agree to hold harmless Island Motor Tours, Inc. from any
liability or injury that should be considered as a
direct or indirect result of our use of photo and video
documentation as described herein. |
 |
Island Motor Tours, Inc.
agrees not to use any photo or video documentation in a
manner that would be considered defamatory or insulting
to an individual's character. |
 |
Island Motor Tours, Inc.
agrees not to publish, sell, barter, transfer or use any
photo or video in any manner that may unintendedly or
intendedly capture the partial or full nudity of a
driver or passenger or minor. |
 |
Island Motor Tours, Inc.
agrees not to sell, barter or transfer any and all photo
and video documentation, for private or commercial use,
to any individual, company or corporation unless having
first obtained written consent to release by all parties
identified in said photographs and/or videos. |
 |
Island Motor Tours, Inc. is
constrained by law to submit any and all photo and/or
video documentation of our tours as may be subpoenaed by
a court of law. |
 |
Driver and passenger may also
make photo and video documentation of their experiences
and activities while on tour, but are strictly
prohibited from making any photo or video that
identifies any member of the security staff of Island
Motor Tours, Inc. |
 |
Any photo or video, if
identified or known to exist, taken by a driver or
passenger, that identifies a member of the security
staff of Island Motor Tours, Inc., shall be immediately
destroyed upon its discovery and without recourse by the
driver or passenger. |
 |
Any and all photo
documentation made by drivers and passengers is
considered released by Island Motor Tours, Inc. for
their personal and private use only. Any commercial use,
sale, barter or transfer to any individual, company or
corporation, of photos or videos taken by a driver or
passenger while in the presence of a tour group of
Island Motor Tours, Inc., is expressly prohibited. |
 |
Any and all photographic and
video content that is used by Island Motor Tours, Inc on
our website, in advertisements or printed brochures
shall be copyrighted by Island Motor Tours, Inc. Any and
all persons appearing in any photo or video published by
Island Motor Tours, Inc. agrees not to challenge our
right to copyright.

Verbal
Agreements
 |
Any verbal agreement issued
by an officer, employee, contractor or vendor of Island
Motor Tours, Inc. is considered to be non-binding and
shall not change the terms and conditions as set forth
herein. |
 |
Any changes to, inclusions to
or deletions from the terms and conditions, as set forth
herein, must be made in writing, issued by the President
of Island Motor Tours, Inc. and signed by the customer,
at which time, such changes, inclusions to and/or
deletions from the terms and conditions as set forth
herein shall become in full force and binding.

Contracts for tours made
under any previous version of the terms and conditions
shall be subject only to the terms and conditions under
which the contracts were established and shall not be
binding to any future changes to, additions to or
deletions from the original terms and conditions.

Indemnification,
Exclusions & Release of Liability

Both driver and passenger,
their heirs, successors, and assigns, agree to release,
indemnify, and hold harmless Island Motor Tours, Inc.,
its officers, agents, contractors, vendors and employees
from any and all liability or claims, directly or
indirectly related to their participation on a
motorcycle tour operated by Island Motor Tours, Inc.. |

Both driver and passenger,
their heirs, successors, and assigns, agree to release,
indemnify, and hold harmless Island Motor Tours, Inc.,
its officers, agents, contractors, vendors and employees
from any and all liability or claims, directly or
indirectly related to their use and operation of a
motorcycle supplied by Island Motor Tours, Inc.. |

Island Motor Tours, Inc., its
contractors and employees are not responsible or liable
for any delays or changes in the tour itinerary that may
result due to conditions beyond our control or due to
the failure of our contracted vendors to fulfill their
contractual obligations. |
 |
Island Motor Tours, Inc., its
contractors and employees are not responsible or liable
for any loss or damage to personal property, bodily
injury or death resulting from the use of a motorcycle
owned by Island Motor Tours, Inc. or resulting from
participating in any other tour activities. |
 |
Island Motor Tours, Inc., its
contractors and employees are not responsible or liable
for any loss or damage to personal property, bodily
injury or death resulting from the careless or unsafe
operation of a motorcycle, owned by Island Motor Tours,
Inc., and caused by another member of the tour group
and/or tour support staff and/or tour guide. |
 |
Island Motor Tours, Inc., its
contractors and employees are not responsible or liable
for any loss or damage to personal property, bodily
injury or death resulting from the acts of an
independent motorist or pedestrian. |
 |
Island Motor Tours, Inc., its
contractors and employees are not responsible or liable
for any loss or damage to personal property, bodily
injury or death resulting from worsening or poor road
conditions, road hazards or inclimate weather. |
 |
Island Motor Tours, Inc., its
contractors and employees are not responsible for any
acts of God, strikes, thefts, vandalism, terrorist
attacks or any other conditions beyond our control.

 |
Island Motor Tours, Inc., its
contractors and employees are not responsible or liable
for any personal property lost, damaged or stolen while
on a motorcycle tour. |
 |
Island Motor Tours, Inc., its
contractors and employees are not responsible or liable
for any physical injury or complication to existing
injuries incurred during or as a direct or indirect
result of administering life saving first aid. |
 |
Island Motor Tours, Inc., its
contractors and employees are not responsible or liable
for mental illnesses or disorders, emotional scarring or
any other physical disease or disorder that is caused
directly or indirectly by any event that should
transpire while on any tour operated by Island Motor
Tours, Inc.

Venue
and Jurisdiction
 |
The agreement between Island
Motor Tours, Inc. and the Tour Participants is deemed as
having been made in Butuan City, Agusan Del Norte,
Philippines and in the case of any disputes, such shall
be decided in accordance with contractual and general
laws of the Republic of the Philippines.
|
 |
The parties named herein
agree that any and all disputes shall be subject to the
venue and jurisdiction of the proper courts of Butuan
City, Agusan Del Norte, Philippines.
|
|
 |
Corrections
and Partial Invalidity
 |
Island Motor Tours, Inc.
reserves the right to correct typographical errors or
omissions to our website and/or the tour itinerary
and/or the terms of agreement at any time.
|
 |
Changes to any individual
terms, or rulings of invalidity of any of the individual
terms, as set forth in the terms and agreement herein,
shall not constitute the invalidity of the terms and
agreement as a whole and all unaffected terms shall
remain in full force and binding.
|
|
 |
Acknowledgement
of the Terms and Conditions
 |
Each driver and passenger
must read, accept and sign in consent and agreement to
the terms and conditions, as set forth herein, at the
time of indoctrination and before the issuance of
motorcycle and cell phone. |
 |
In the event a tour guest
refuses to sign this form at the time of indoctrination,
the tour guest will voluntarily forfeit their position
on the tour and their payments in full. Such refusal to
sign and agree to the terms and conditions shall be
considered the voluntary decision to leave the tour
group and shall be subject to the terms and conditions
as set forth herein under the heading
Special Arrangements. |

By signing the terms and
agreement, as set forth herein, the driver and the
passenger accept of the risks of personal injury,
property damage and/or any loss associated with their
participation on a tour offered by Island Motor Tours,
Inc.. |
 |
All parties herein agree to
be bound by their decisions including all decrees and
agreements. |
